Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Ballpark Pal, including any website, application, content, data, projections, ratings, subscription features, and related services offered by Pal Sports LLC ("Pal Sports," "we," "us," or "our").

By accessing or using Ballpark Pal, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use Ballpark Pal.

1. Eligibility

You must be at least 18 years old to access or use Ballpark Pal. By using Ballpark Pal, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of the Service

Ballpark Pal is an MLB research platform that provides projections, ratings, analytics, and other data related to each day's slate of Major League Baseball games. Ballpark Pal is provided for informational, analytical, research, and entertainment purposes only.

We may modify, update, suspend, discontinue, or restrict access to any part of Ballpark Pal at any time, with or without notice.

3. No Gambling, Betting, Financial, or Professional Advice

Ballpark Pal is not a sportsbook, gambling operator, bookmaker, casino, financial advisor, or professional advisory service. Nothing on Ballpark Pal constitutes gambling advice, betting advice, financial advice, investment advice, legal advice, or any other professional advice.

You are solely responsible for any decisions you make based on information available through Ballpark Pal. If you use Ballpark Pal in connection with wagering, fantasy sports, contests, financial decisions, or any other activity involving risk, you do so entirely at your own risk.

We do not guarantee any outcome, result, profitability, performance, accuracy, or success rate. Past performance, historical data, ratings, model outputs, or projections do not guarantee future results.

4. No Reliance

You acknowledge and agree that you are not relying on Ballpark Pal, Pal Sports, or any Ballpark Pal content as the sole basis for any decision. You are responsible for independently evaluating all information, projections, ratings, and data before taking any action.

All projections, ratings, and model outputs involve uncertainty and may be incomplete, inaccurate, outdated, or incorrect. You assume all risks associated with your use of Ballpark Pal and any decisions made in connection with it.

5. Accounts

Certain features may require an account. You agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You may not share, transfer, sell, or sublicense your account or subscription access. We may suspend, restrict, or terminate your account if we believe you have violated these Terms, misused Ballpark Pal, created risk for Pal Sports, or engaged in unlawful, harmful, abusive, or unauthorized conduct.

6. Subscriptions, Billing, and Refunds

Ballpark Pal may offer limited free access before requiring a paid subscription. Subscription terms, prices, billing intervals, and available features may be displayed at the time of purchase and may change from time to time.

If you purchase a subscription, you authorize us or our payment processor to charge the payment method you provide for applicable fees, taxes, and recurring subscription charges. Unless otherwise stated at checkout, subscriptions automatically renew until canceled.

You are responsible for canceling your subscription before the next billing period if you do not wish to be charged. Refunds are discretionary. We are not obligated to provide refunds or credits, but we may choose to do so on a case-by-case basis.

7. Intellectual Property

Ballpark Pal, including its software, design, text, graphics, logos, trademarks, trade names, data compilations, projections, ratings, models, methodologies, user interface, and related materials, is owned by Pal Sports or its licensors and is protected by intellectual property and other laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Ballpark Pal for your personal, non-commercial use.

You may not copy, reproduce, distribute, sell, resell, sublicense, publicly display, publish, scrape, harvest, download in bulk, reverse engineer, decompile, modify, create derivative works from, or otherwise exploit Ballpark Pal or its content except as expressly permitted by us in writing.

8. Restrictions on Use

You agree not to:

• Use Ballpark Pal for any unlawful, fraudulent, abusive, or harmful purpose;
• Access or use Ballpark Pal if you are under 18 years old;
• Share your account, login credentials, or subscription access with others;
• Scrape, crawl, index, harvest, or use automated means to access Ballpark Pal or collect data from it;
• Redistribute, resell, publish, or commercially exploit Ballpark Pal content, projections, ratings, or data;
• Attempt to reverse engineer, replicate, interfere with, or derive the underlying models, systems, or methodologies used by Ballpark Pal;
• Bypass, disable, or interfere with any access controls, paywalls, security features, or usage restrictions; or
• Violate any applicable law, regulation, league rule, platform rule, or third-party right.

9. Third-Party Data and External Information

Ballpark Pal may rely on, reference, incorporate, or analyze information from third-party or publicly available sources, including sports schedules, game data, statistics, player information, injury information, weather-related information, odds-related information, and other external data.

We do not control third-party sources and are not responsible for their accuracy, completeness, availability, timeliness, or reliability. Third-party information may change without notice and may be delayed, inaccurate, incomplete, or unavailable.

10. Data Accuracy and Availability

We aim to provide useful MLB research tools, but we do not guarantee that Ballpark Pal or any content available through it will be accurate, complete, current, uninterrupted, secure, or error-free. MLB schedules, probable pitchers, lineups, injuries, weather conditions, game statuses, statistics, and other relevant information may change quickly.

We are not responsible for losses, damages, or consequences arising from inaccurate, incomplete, delayed, unavailable, or misunderstood information.

11. Beta, Experimental, and Model-Based Features

Some Ballpark Pal features may be experimental, in beta, or based on statistical models. Model-based outputs are inherently uncertain and may produce unexpected, inaccurate, or unreliable results. We may add, change, remove, recalibrate, or discontinue any model, rating, projection, methodology, or feature at any time without notice.

12. Disclaimer of Warranties

Ballpark Pal is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pal Sports disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not warrant that Ballpark Pal will meet your requirements, achieve any intended result, be compatible with your devices or systems, operate without interruption, be secure, or be free of errors, defects, viruses, or harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, Pal Sports and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, betting losses, financial losses, or missed opportunities, arising out of or relating to your access to or use of Ballpark Pal.

To the fullest extent permitted by law, the total liability of Pal Sports and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers for any claim arising out of or relating to Ballpark Pal or these Terms will be limited to zero dollars ($0).
